Easement Right of Way License Application

An Easement is the right to use property for a specific purpose. Applicants seeking to license a portion of an easement or right-of-way for private use must process a request with the Right-of-Way and Property Management Division.

Application Requirements

Step 1.Review Requirements

The following is required prior to issuance of a Easement Row License:

  • The application must be signed by the applicant and notarized – clearly legible contact information such as names, addresses, telephone numbers, fax numbers and e-mail addresses are needed to ensure timely processing;
  • A sketch or description of the area sought to be licensed must be marked “Exhibit A” and attached to the application. A metes and bounds legal description from a licensed surveyor will also be required as an attachment for the license agreement;

  • Licensee may be required to procure and maintain at its sole cost and expense, Comprehensive General Liability Insurance with a combined single limit of liability of not less than $2,000,000 naming the City as an additional insured without any qualifications or restrictions, and providing that the City be given thirty (30) days prior written notice of any proposed cancellation or modification. The policy shall be endorsed waiving the issuing insurance company's rights of recovery against the City whether by way of subrogation or otherwise;

  • The applicant is responsible for circulating the application to the utility companies listed on “Exhibit B” and securing the signatures of the authorized representatives prior to submitting the application to the City – faxed signatures are acceptable;

  • The applicant should provide a brief description of why the license is needed on the application form and state what type of easement or right-of-way is sought for private use and any known current or previous uses of the easement or right-of-way;

  • A copy of the applicant’s recorded deed to the underlying property is needed to ensure ownership and to verify the correct name or names to be used on the license agreement which is to be approved by the City Council.

You can apply online for a "Right of Way License Agreement" through the City of Grand Prairie's Customer Self-Service portal . First time users will need a valid email address to set up an account. It takes about 5 minutes to create a new account.

What next?

Generally, complete applications are scheduled for City Council action within six to eight weeks after submittal, provided no objections are received.

Application Fees

  • Easement Row License Application Fee: $100. There may be a first year’s annual fee, based on the market value of the area used, must be paid at the time the license is approved or a lump sum fee at time the license is signed by the applicant.
  • Application and payment are submitted through the online Self-Service portal.
